  • Article 1

    Amnesty shall be granted to persons who have committed or are reasonably suspected of having committed the following criminal acts, from 7 October 2000 to the effective date of the present Law: evasion of military service as referred to in Article 394, evasion of registration and examination as referred to in Article 395, failure to perform the financial duty referred to in Article 396, evasion of military service by incapacitation and deception as referred to in Article 397 and absence without leave and desertion from the Army of Serbia and Montenegro as referred to in Article 399, provided by the Criminal Code (published in the Sluzbeni glasnik RS, Nos. 86/05, 88/05 and 107/05) and earlier by the Elementary Criminal Law (published in the Sluzbeni list SFRJ, Nos. 44/76, 36/77, 34/84, 37/84, 74/87, 57/89, 3/90, 38/90, 45/90 and 54/90, Sluzbeni list SRJ, Nos. 35/92, 16/93, 31/93, 37/93, 41/93, 50/93, 24/94 and 61/01, and Sluzbeni glasnik RS, No. 39/03).

    The amnesty granted to the persons referred to in paragraph 1 of this Article shall include acquittal, exemption from the service of sentence and deletion of conviction.

  • Article 2

    If criminal proceedings have not been instituted against a person referred to in Article 1 of the present Law, such proceedings shall not be instituted and if criminal proceedings are in progress, they shall be suspended.

    If a person referred to in Article 1 of the present Law has been effectively sentenced to a prison term, he shall be exempt from the service of that sentence wholly or from the part not served.

  • Article 3

    Amnesty shall not affect the rights of third parties that are based on the sentence.
