  • Subject Matter of the Law
     Article 1

    This Law shall govern the conditions for having the construction products placed on the market and made available thereon, for the preparation of the performance label and placement of conformity marking on the construction products ,the obligations of companies, the technical regulations for construction products and the Serbian technical specification, the simplified procedures, the bodies for technical assessment, the bodies for assessment and verification of constancy of construction products performance, the validity of documents on conducted assessment and verification of performance constancy of construction products and the conformity marking issued abroad and other issues significant for the area of construction products. 

  • Terms
     Article 2

    Certain terms used in this Law shall have the following meaning:

    1) family of construction products shall be understood to mean a group of similar products which have the similar prescribed use;

    2) kit shall be understood to mean a construction product placed on a market by a single manufacturer as a set of at least two separate components that need to be put together to be incorporated into a facility; 

    3) essential characteristics shall be understood to mean those characteristics of the construction product which relate to the basic requirements for facilities;

    4) performance of a construction product shall be understood to mean the indicators related to the relevant essential characteristics thereof (expressed by level or class, or in a description);

    5) level shall be understood to mean the result of the assessment of the performance of a construction product in relation to its essential characteristics, expressed as a numerical value;

    6) class shall be understood to mean a range of level of performance of a construction product, from minimal to maximal value;

    7) threshold level shall be understood to mean a minimum performance value of a construction product which needs to be achieved or a maximum value which is not to be exceeded;

    8) product-type shall be understood to mean the set of representative performance levels or classes of a construction product, in relation to its essential characteristics, produced using a given combination of raw materials or other elements in a specific production process;

    9) technical specification shall be understood to mean the harmonized technical specification and the Serbian technical specification;

    10) Harmonized technical specifications shall be understood to mean the harmonized standards and European Assessment Documents;

    11) Serbian technical specification shall be understood to mean the Serbian standards from the list of Serbian standards by means of which harmonized standards have been adopted and which are applied in line with this Law, the Serbian standard to which the technical regulation and the Serbian Assessment Documents refer to;

    12) harmonized standard shall be understood to mean a standard adopted on the basis of a request issued by the European Commission for the purpose of application in the harmonized legislation of the European Union;

    13) Serbian standard shall be understood to mean the standard adopted by the national body for standardization in the Republic of Serbia;

    14) assessment document shall be understood to mean the Serbian Assessment Document and the European Assessment Document;

    15) European Assessment Document shall be understood to mean a document adopted by the organization of technical assessment bodies for the purposes of issuing European Technical Assessments;

    16) Serbian Assessment Document shall be understood to mean a document prepared by the technical assessment body for the need of issuing Serbian technical assessments;

    17) European Technical Assessment shall be understood to mean the documented assessment of the performance of a construction product, in relation to its essential characteristics, in accordance with the respective European Assessment Document;

    18) Serbian Technical Assessment shall be understood to mean the documented assessment of performance of a construction product, in relation to its essential characteristics, in accordance with the respective Serbian Assessment Document;

    19) intended use shall be understood to mean the intended use of the construction product as defined in the respective technical specification or technical regulation;

    20) Specific Technical Documentation shall be understood to mean the documentation demonstrating that methods within the applicable system for assessment and verification of constancy of performance have been replaced by other methods, provided that the results obtained by those other methods are equivalent to the results obtained by the test methods of the corresponding Serbian standard by means of which the harmonized standard has been adopted, applied in line with this Law;

    21) making available on the market shall be understood to mean any supply of a construction product for distribution or use whether in return for payment or free of charge;

    22) placing on the market shall be understood to mean the first making available of a construction product on the market of the Republic of Serbia;

    23) economic operator shall be understood to mean the manufacturer, importer, distributor of a construction product;

    24) manufacturer shall be understood to mean any legal entity or entrepreneur who manufactures a construction product or who has such a construction product designed or manufactured for, and markets that product under his name or trademark;

    25) distributor shall be understood to mean any legal entity or entrepreneur registered in the Republic of Serbia, involved in the supply chain and who, within its activity, other than the manufacturer or the importer, makes a construction product available on the market;

    26) importer shall understood to mean any legal entity or entrepreneur registered in the Republic of Serbia, who places a construction product from other countries;

    27) representative shall be understood to mean any legal entity or entrepreneur registered in the Republic of Serbia, authorized by the manufacturer to act on his behalf in relation to specified tasks and in respect to the placement of construction product on the market of the Republic of Serbia;

    28) withdrawal shall be understood to mean any measure aimed at preventing a construction product in the supply chain from being made available on the market;

    29) recall shall be understood to mean any measure aimed at achieving the return of a construction product that has already been made available to the end-user;

    30) factory production control shall be understood to mean the documented, permanent and internal control of production in a factory, in accordance with the relevant technical specification and the technical regulation;

    31) micro legal entity shall bear the meaning in accordance with the special regulations which govern the classification of legal entities;

    32) life cycle shall be understood to mean the consecutive and interlinked stages of a construction product's life, from raw material acquisition or generation from natural resources to final disposal;

    33) electronic contact point for construction products shall be understood to mean the state electronic service, by means of which all interested parties shall be provided information free of charge in relation to the provisions of regulations on construction products in the territory of the Republic of Serbia;

    34) technical assessment body shall be understood to mean the legal entity conducting the assessment of performances and the issuing of the technical assessment for the area of construction products designated thereto;

    35) system of assessment and verification of performance constancy shall be understood to mean the procedure conducted with the aim of ensuring conformity of a construction product with the performances of essential characteristics specified in the performance declaration set forth in the relevant technical specification, technical regulation or the Serbian Technical Assessment;

    36) documents on conducted assessment and verification of performance constancy shall be, depending on the applied system of assessment and verification of performance constancy: the performance declaration, the certificate of performance constancy of a construction product, certificate of compliance of factory production control and the test report, confirming constancy and/or verifying the performances of a construction product in relation to its essential characteristics set forth in the relevant technical specification or the technical regulation;

    37) basic requirements for facilities shall be understood to mean the requirements that a facility is to meet during the economically acceptable working life;

    38) designated body for assessment and verification of performance constancy shall be understood to mean the legal entity having the approval of the minister competent for civil engineering affairs, for the performance of tasks of an independent third party within the procedure of assessment and verification of performance constancy of a construction product, in line with the Serbian technical specification or technical regulation and which has been entered into the relevant register of such bodies;

    39) notified body shall be understood to mean the designated body for assessment and verification of performance constancy reported to the European Commission and the member states of the European Union as the independent third party for the performance of tasks of assessment and verification of performance constancy of construction products in line with the harmonized technical specification and entered into the relevant register of such bodies maintained by the European Commission ("NANDO base")

    40) construction product shall be understood to mean each product or kit manufactured and placed on market for the purpose of permanent integration into facilities or parts thereof and whose performances affect the performance of facilities in relation to the basic requirements for facilities.

    Other terms used in this Law, and which have not been defined in paragraph 1 of this Article, shall bear the meaning set forth by the regulations governing the construction, technical requirements for products and assessment of conformity, general product safety, substance management, market surveillance, accreditation and standardization. 

  • Application of the Law
     Article 3

    This Law shall be applied to all construction product which have been classified according to the following areas of construction products:

    1) precast normal/lightweight/autoclaved aerated concrete products;

    2) doors, windows, shutters, gates and related building hardware;

    3) membranes, including liquid applied and kits (for water and/or water vapour control);

    4) thermal insulation products and composite insulating kits/systems;

    5) structural bearings and pins for structural joints;

    6) chimneys, flues and specific products;

    7) gypsum products;

    8) geotextiles, geomembranes, and related products;

    9) curtain walling/cladding/structural sealant glazing;

    10) fixed firefighting equipment (fire alarm/detection, fixed firefighting, fire and smoke control and explosion suppression product);

    11) sanitary appliances;

    12) circulation fixtures: road equipment;

    13) structural timber products/elements and ancillaries;

    14) wood based panels and elements;

    15) cement, building limes and other hydraulic binders;

    16) reinforcing and prestressing steel for concrete (and ancillaries), post tensioning kits;

    17) masonry and related products, masonry units, mortars, and ancillaries;

    18) waste water system construction products;

    19) floorings;

    20) structural metallic products and ancillaries;

    21) internal & external wall and ceiling finishes, internal partition kits;

    22) roof coverings, roof lights, roof windows, and ancillary products and roof kits;

    23) road construction products;

    24) aggregates;

    25) construction adhesives;

    26) products related to concrete, mortar and grout;

    27) space heating appliances;

    28) pipes-tanks and ancillaries not in contact with water intended for human consumption;

    29) construction products in contact with water intended for human consumption;

    30) flat glass, profiled glass and glass block products;

    31) power, control and communication cables;

    32) sealants for joints;

    33) fixings;

    34) building kits, units, and prefabricated elements;

    35) fire stopping, fire sealing and fire protective products and fire retardant products.

    If technical and other requirements for construction products referred to in paragraph 1 of this Article have not been set forth by the Serbian Technical Specification or the technical regulation, such construction products will not be subject to the provisions of regulations governing the general safety of products and regulations governing the consumer protection.

    The use of construction products, instalment and performances that a construction product needs to have in relation to its essential characteristics, shall be governed by the technical regulations governing the construction of facilities and other regulations governing the issues that the affect the fulfilment of the basic requirements for such facilities.

    The methods used in the prescription of requirements for the said facilities, as well as the regulations referring to the essential characteristics of the construction products and other issues referring to the area of construction products, must be in line with the Serbian standards by means of which the harmonized standards have been adopted.
