  • Article 1

    This Law shall regulate the requirements in terms of the standard of fineness of the precious metals articles, solders, coating of other precious metals, requirements in terms of the parts of articles made of non-precious metals, conformity assessment conditions and method for precious metals articles and recognition of international marks shall be regulated, obligation to pay duties for actions taken and acts issued in conformity assessment procedure and/or assaying and marking of precious metals articles shall be laid down, purchase of second-hand precious metals articles shall be regulated, conducting controls in the field of precious metals articles, as well as other issues of significance for placing the precious metals articles on the market shall be regulated.

  • Article 2

    Provisions of this Law shall not apply to:

    1) precious metals articles intended for export;

    2) precious metals articles coated with enamel, precious stones, pearls or other non-metallic materials;

    3) precious metals articles manufactured or temporarily imported as samples for exhibitions and fairs and not intended for placing on the market;

    4) other metal items coated with precious metals;

    5) older precious metals articles with scientific, historical or cultural value, as well as feathers for fountain pens;

    6) investment gold within the meaning of the law governing the value added tax, as well as the investment silver, platinum and palladium;

    7) articles or parts of articles used for medical, dentist, veterinary, scientific and industrial purposes.

  • Article 3

    Individual terms used in this Law shall have the following meanings:

    1) precious metals shall be platinum, gold, palladium and silver;

    2) a precious metal alloy shall mean a solid homogenous mixture made of at least one precious metal and one or more other metals;

    3) fineness shall mean the mass of a precious metal contained in the overall mass of an alloy, expressed in parts per thousand;

    4) fineness mark shall mean the numerical value corresponding to one of the prescribed standards of fineness;

    5) standard of fineness shall mean the minimum mass of a precious metal contained in the total mass of an alloy, expressed in parts per thousand;

    6) national mark shall mean the mark of the standard of fineness certifying conformity of precious metals articles with the prescribed requirements, as well as that a precious metal article has been manufactured in the fineness which is equal to or greater than the prescribed one for that standard of fineness, and less than the following standard of fineness;

    7) precious metal article shall mean jewellery, as well as any other object made of a precious metal or its alloys, which comprises all the parts necessary to make it complete;

    8) mixed article shall mean an article the integral parts of which are made of different precious metals, their alloys, other metals or other materials, as well as an article the integral parts of which are made of one precious metal of different standards of fineness;

    9) precious metal coating shall mean a coat of a precious metal applied to the object or to the parts thereof by a chemical, electrochemical, mechanical or some other process;

    10) solder shall mean a precious metal alloy that can be used as a binding material only;

    11) semi-finished article shall mean the lever, casting, granule and other forms made of a precious metal or its alloy intended for manufacturing of the final product;

    12) economic operator shall mean a company or another legal person and/or an entrepreneur registered in the Republic of Serbia in compliance with the law regulating registration of economic operators, which is placing the precious metals articles on the market;

    13) manufacturer shall mean the economic operator which is registered in the Republic of Serbia in compliance with the law regulating registration of economic operators and to which the Directorate of Measures and Precious Metals has issued a decision on the manufacturer's mark;

    14) dealer shall mean the economic operator which is registered in the Republic of Serbia in compliance with the law regulating registration of economic operators and which is registered with the Directorate of Measures and Precious Metals as a dealer of precious metals articles and their parts;

    15) importer shall mean the economic operator which is registered in the Republic of Serbia in compliance with the law regulating registration of economic operators, which is importing the precious metals articles and to which the Directorate of Measures and Precious Metals has issued a decision on importer's mark;

    16) agent shall mean the economic operator which is registered in the Republic of Serbia in compliance with the law regulating registration of economic operators, which is representing the manufacturer that has authorized him to take actions from the power of attorney on his behalf relating to placing the precious metals articles on the market of the Republic of Serbia and to which the Directorate of Measures and precious metals has issued a decision on the agent's mark;

    17) manufacturer's mark shall mean the mark whereby the manufacturer marks the precious metals articles, in compliance with this Law;

    18) importer's mark shall mean the mark whereby the importer marks the precious metals articles, in compliance with this Law;

    19) agent's mark shall mean the mark whereby the agent marks the precious metals articles, in compliance with this Law;

    20) labelling of precious metals articles shall mean impressing of the mark of manufacturer, importer and/or agent, and the corresponding fineness mark;

    21) testing of precious metals articles shall mean the procedure whereby compliance of the precious metals articles with the prescribed requirements is assessed;

    22) marking of precious metals articles shall mean labelling of precious metals articles with the state or international mark in compliance with the ratified international agreement to which the Republic of Serbia is a signatory;

    23) placing of precious metals articles on the market shall mean the first delivery of the precious metals' articles to the market of the Republic of Serbia;

    24) register of dealer shall mean the public register maintained by the Directorate of Measures and Precious Metals in written and electronic form and published on its web site.

    Other terms used in this Law, which are not defined in paragraph 1 of this Article, shall have the meanings defined in the laws regulating technical requirements for products and conformity assessment and standardisation.
