  • Article 1

    This Law shall regulate the position, competence and procedure before the Protection of Citizens as an independent state authority that shall protect the rights of citizens and control the work of state administrative authorities, an authority competent for legal protection of property rights and interests of the Republic of Serbia, as well as other authorities and organisations, enterprises and institutions entrusted with public authorisations (hereinafter referred to as: the administrative authorities).

    The Protector of Citizens shall ensure protection and promotion of human and minority rights and freedoms.

    The term citizen, within the meaning of this Law, shall include not only the natural persons that are local nationals, but also the foreign nationals and stateless persons, as well as each domestic or foreign legal person whose rights and obligations are subject to decisions of administrative authorities referred to in paragraph 1 of this Article.

    All the terms used in this Law in grammatical male gender shall include the natural male and female gender of the person to which they refer.

  • Article 2

    The Protector of Citizens shall perform the tasks of the national mechanism for the prevention of torture, in accordance with the Law on Ratification of the Optional Protocol to Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment (Službeni list SCG - Međunarodni ugovori, Nos. 16/05 and 2/06 and Službeni glasnik RS - Međunarodni ugovori, No. 7/11).

    The Protector of Citizens shall perform the tasks of the national independent implementation monitoring mechanism for the Convention on the Rights of Persons with Disabilities, in accordance with the Law on Ratification of the Convention on the Rights of Persons with Disabilities (Službeni glasnik RS - Međunarodni ugovori, No. 42/09).

    The Protector of Citizens shall perform the tasks of the national rapporteur in the field of trafficking in human beings, in accordance with the Law on Ratification of the Council of Europe Convention on Action against Trafficking in Human Beings (Službeni glasnik RS - Međunarodni ugovori, No. 19/09).

    The Protector of Citizens shall have the status of a special body that protects, promotes and furthers rights of the child.

  • Article 3

    The Protector of Citizens shall be independent and autonomous when performing the tasks laid down by this Law and nobody shall have the right to exert any influence on his work and actions.

    When performing the tasks within his remit, the Protector of Citizens shall act within the Constitution, laws and other general acts, as well as within the ratified Međunarodni ugovori and generally accepted rules of the international law.

    The Protector of Citizens shall answer for his work to the National Assembly.
