    • Article 1

      This Law shall regulate: the objectives of agricultural policy and rural development policies, as well as the method of their implementation, the Register of Agricultural Holdings, registration and reporting in agriculture, as well as supervision of the implementation of this Law.

      This Law shall also regulate the rules of the special procedure for implementation and control of the IPARD program.

      This Law shall establish the Directorate for Agrarian Payments, as an administration body within the Ministry competent for agriculture (hereinafter referred to as: Ministry) and shall regulate its jurisdiction.

      The manner of education, structure, i.e. organization of the Directorate for Agrarian Payments shall be regulated by the act of the Minister competent for agriculture (hereinafter referred to as: the Minister).

    • Article 2

      The individual terms used in this Law shall have the following meaning:

      1) agriculture is an economic activity including those activities classified as agriculture by law;

      2) agricultural production is the process of production of plant and livestock products, farming of fish, bees, or other forms of agricultural production (cultivation of mushrooms, snails, greenhouse production, cultivation of spicy and medicinal herbs and others), which is carried out on agricultural land, as well as on other land or construction unit located on the territory of the Republic of Serbia;

      3) agricultural products are the primary products and products of the first stage of their processing formed in agricultural production;

      4) agricultural holding shall be a production unit where a company, agricultural cooperative, institution or other legal entity, entrepreneur or natural person - farmer performs agricultural production, i.e. performs processing of agricultural products, i.e. performs other non-agricultural activities (rural tourism, old crafts, etc);

      5) family farm is an agricultural holding where a natural person - farmer, together with members of his household, carries out agricultural production, i.e. performs processing of agricultural products, i.e. performs other non-agricultural activities (rural tourism, old crafts, etc.);

      6) the holder of the family farm is a natural person - a farmer and entrepreneur carrying out agricultural production, i.e. performing processing of agricultural products, i.e. performs other non-agricultural activities (rural tourism, old crafts, etc.) and entered in the Register of Agricultural Holdings, as the holder of the family farm;

      7) a member of a family farm is an adult member of the same household, who is constantly or occasionally engaged in farm work and who is registered in the Register of Agricultural Holdings as a member of the family farm, on the basis of a statement that he is a member of the family farm, i.e. a minor member of the same farm on the basis of the statement of the parent or legal guardian;

      8) (Deleted)

      9) incentives are funds provided in the budget of the Republic of Serbia, as well as funds from other sources allocated to agricultural holdings and other persons in accordance with this Law in order to achieve the objectives of agricultural policy;

      10) agricultural land are considered to be fields, gardens, orchards, vineyards, meadows, pastures, ponds, reeds and wetlands, as well as other land (sinkholes, abandoned river beds, lands overgrown with low shrubby vegetation and others), which according to its natural and economic conditions can be rationally used for agricultural production;

      10a) the Instrument for Pre-Accession Assistance (IPA) is an EU financial instrument supporting the EU enlargement strategy, intended to assist candidates and potential candidates in the EU accession process;

      10b) the framework agreement is an agreement between the Republic of Serbia and the European Commission on rules for the implementation of European Union financial assistance to the Republic of Serbia under the Instrument for Pre-Accession Assistance (IPA II);

      10v) IPARD is the EU financial instrument for pre-accession assistance to rural development under the Instrument for Pre-Accession Assistance (IPA);

      10g) IPARD programme is a rural development programme within the Instrument for Pre-Accession Assistance to Rural Development (IPARD), funded by EU pre-accession assistance, as well as from the budget of the Republic of Serbia;

      10d) IPARD incentives are incentives to rural development granted to agricultural holdings and other persons under the IPARD program;

      10đ) the project is the entire activity of the applicant for the approval of the project in connection with the investment, consisting of a part of the investment that is acceptable and the part that is unacceptable for financing under the IPARD programme;

      10e) the investment is part of the project eligible for financing under the IPARD Programme;

      10z) the reference price is the price of an investment or part of the investment determined on the basis of the market price and serves to determine the basis for the calculation of IPARD incentives;

      10z) the beneficiary of the IPARD incentive is a person who has been granted a project to use the IPARD incentive;

      10i) the recipient of funds is the beneficiary of the IPARD incentive to whom the funds have been paid
