  • Article 1

    This Law shall regulate the lists of active substances; procedures for adopting acts based on which biocidal products are made available on the market and used; research and development; classification; packaging; labelling; advertising and safety data sheets of biocidal products; Register of Biocidal Products; safe use of biocidal products; placing on the market and labelling treated products; supervision and other issues of importance for safe placement on the market and use of biocidal products and treated products.

  • Article 2

    This Law shall be based on the precautionary principle, which ensures a high level of protection of human health, animal health and the environment, and especially the protection of vulnerable groups.

  • Article 3

    The provisions of this Law shall not apply to:

    1) medicated animal feed;

    2) active implantable medical devices, in vitro diagnostic medical devices and medical devices;

    3) veterinary drugs and drugs for use in human medicine;

    4) feed additives;

    5) food hygiene (food products) and hygiene of food of animal origin;

    6) food additives;

    7) flavours and other ingredients with aromatic properties for use in food;

    8) animal feed;

    9) plant protection products;

    10) cosmetic products;

    11) toys;

    12) detergents and surfactants in detergents to which the law governing chemicals applies, and which do not have a biocidal effect;

    13) food or feed used as repellents or attractants and biocidal products used as auxiliaries in the production of feed or feed.

    Notwithstanding paragraph 1 of this Article, the provisions of this Law shall apply to biocidal products and treated products used for purposes not covered by the regulations governing the areas referred to in paragraph 1 of this Article.

    The provisions of this Law relating to the classification, packaging and labelling of biocidal products shall not apply to the transport of biocidal products.

    Treated products which are biocidal products, as well as products treated only by fumigation or disinfection of premises or containers used for storing or transport and where there is no residuals after such treatment shall not be subject of provisions of this Law relating to placing on the market and labelling treated products.
